The European Securities and Markets Authority (ESMA) has today updated its Questions and Answers (Q&As) regarding commodity derivatives under the Market in Financial Instruments Directive (MiFID II) and Regulation (MiFIR). This update relates to position limits and position reporting.

ESMA has also updated today its list of liquid commodity derivative contracts for position limit purposes. The list also now includes the position limits and the ESMA opinion in relation to the ICE Brent Crude contract.

These documents are aimed at national competent authorities and firms by providing clarity on the application of the MiFID II and MiFIR requirements. MiFID II introduces reporting requirements for commodity derivatives which are also subject to position limits.

The ESMA statement and related information is available here.
